原标题：今年上半年起诉各类证券犯罪147人，同比上升93.4%南都湾财社讯 记者王玉凤9月9日，最高检联合最高法、公安部、中国证监会召开的“依法从严打击证券违法犯罪 为资本市场营造良好法治环境”公布了5个典型案例，涉及涉及违规披露、不披露重要信息罪、操纵证券市场罪等。良好的法治环境，是资本市场健康有序稳定发展的重要保障。去年3月，中央办公厅、国务院办公厅印发《关于依法从严打击证券违法活动的意见》，对从严打击证券期货违法活动进行了全面部署，意见特别强调，要完善证券案件检察体制机制。2021年至今年6月，全国检察机关共起诉各类证券犯罪376人。其中，今年1-6月起诉147人，同比上升93.4%，幅度上升较大。    Filmfare recently hosted the 6th edition of the Filmfare OTT Awards 2025, co-powered by Hyundai and Blenders Pride. As Boman began his acceptance speech, Abhishek lightened the atmosphere with his trademark humour. He joked about how long the speech might run. Starting from Best Film (Web Original) and Best Director (Web Original) to Preeti Panigrahi winning the BEST Actor (Female) Critics' Web Original Film and Kani Kusruti winning Best Supporting Actor, Web Original Film (Female) awards, the show witnessed the entire team going up and accepting the Black Lady again and again. In a heartwarming moment, Richa Chadha, producer of Girls Will Be Girls, also thanked Alia Bhatt for presenting the Best Film (Web Original) award to them. The awards they won include Best Series, Best Director (Series), which went to Vikramaditya Motwane, Satyanshu Singh, Arkesh Ajay, Ambiecka Pandit and Rohin Raveendran. Zahan Kapoor won an award in the Best Actor (Male), Series, Critics: Drama category for his role in the show. Together, these moments made the ceremony feel intimate, joyful and truly unforgettable.     Also Read: Did Vicky Kaushal Show Alia Bhatt a Photo of His Baby at The Filmfare OTT Awards 2025?。5个典型案例发布最高人民检察院第四检察厅厅长、最高人民检察院驻中国证券监督管理委员会检察室主任张晓津在上述发布会上表示，在经济金融环境深刻变化、资本市场改革开放不断深化背景下，伴随着以注册制改革为龙头的资本市场关键制度创新不断突破，资本市场违法行为仍较为突出，财务造假、违规披露、内幕交易、操纵市场、背信损害上市公司利益等违法犯罪活动严重破坏资本市场秩序，损害广大投资者利益，危害资本市场改革发展进程，必须予以严厉打击。“一个案例胜过一打文件”。上述部门发布了5个典型案例，涉及违规披露、不披露重要信息罪，操纵证券市场罪，利用未公开信息交易罪，内幕交易罪，背信损害上市公司利益罪等证券犯罪。这批典型案例彰显了依法从严、全链条打击证券违法犯罪的态度。5个典型案例中，有的既依法追究上市公司财务造假、违规披露的刑事责任，又对不履行“看门人”职责、帮助造假的审计机构予以追诉；有的通过多地多部门联合办案，深挖犯罪线索，查清全部犯罪事实；有的行刑民全方位追责，维护投资人合法权益，从不同侧面展现了对证券违法犯罪从严惩治、全链条追责的司法态度。向公安机关移送涉嫌证券期货犯罪案件60余件 张晓津表示，近年来，检察机关认真贯彻落实中央关于加强资本市场法治建设和依法从严打击证券违法活动等部署要求，与证券监管机构、公安机关、人民法院各负其责、相互配合、互相监督制约，不断健全办理证券犯罪案件的制度机制，加强专业化能力建设，切实提高办案质效，维护资本市场安全。其中，在依法从严惩治证券犯罪上，2021年至今年6月，全国检察机关共起诉各类证券犯罪376人。其中，今年1-6月起诉147人，同比上升93.4%。办理了一批有重大社会影响的财务造假、操纵市场、内幕交易等重点领域案件，形成打击证券犯罪的高压态势。在完善证券案件检察办理体制机制上，2021年9月18日，最高检驻中国证监会检察室揭牌成立；继续加强北京、天津、辽宁、上海、重庆、青岛、深圳等七个证券犯罪办案基地建设，集中办理疑难复杂证券犯罪案件；加强浙江、江苏等案件数量较大地区检察机关办案力量建设。中国证券监督管理委员会稽查局副局长刘永强也表示，今年上半年，证监会稽查系统办理案件400余件，证券市场违法行为多发高发势头得到有效遏制，行政执法刑事司法联合惩戒合力效果持续强化，进一步推动塑造崇法守信的资本市场生态。其中，强化大要案件惩治，提升“零容忍”执法威慑。聚焦重点领域，严厉打击欺诈发行、财务造假、违规占用担保等严重影响上市公司质量违法行为。

二 | 坚持一案多查，严肃追究多家中介机构未勤勉尽责法律责任，进一步压实“看门人”职责。坚持全链条追责，坚决查办上市公司内部人与操纵团伙串通、以伪市值管理形式恶意炒作违法行为,持续加大对并购重组重点环节和上市公司、重组方高管等重要主体内幕交易违法犯罪行为查处力度。刘永强介绍，今年上半年，证监会依法向公安机关移送涉嫌证券期货犯罪案件60余件、犯罪嫌疑人200余人，并同步抄送最高检。并购重组领域仍为内幕交易违法“重灾区”从近年来证监会的稽查执法情况看，证券违法行为有哪些新的特点和变化？刘永强介绍， 随着依法从严打击证券违法工作的深入推进，证券市场违法多发高发势头得到初步遏制，市场生态持续净化，从严监管氛围逐步形成。从近期证监会依法查办案件看，有三个特点。第一，财务造假违规信息披露案件时有发生。供应链金融、商业保理等新业态、新模式逐渐成为掩盖造假的“马甲”，个别案件呈现系列化发展态势。大股东资金占用、违规担保等多种套取公司资金方式，严重损害上市公司利益。企业从事证券违法行为与债券违约、重大违法强制退市等风险隐患相互交织。

三 | 第二，操纵市场专业化、链条化、圈子化特征突出。大股东高比例质押上市公司股票，滋生“伪市值管理”不良动机，伙同配资中介、市场掮客、股市“黑嘴”、资管机构形成灰黑利益链条。“云分仓”配资技术、程序化交易、高频交易等信息化、智能化工具迭代升级迅速，成为异常交易监控、行政调查取证的新挑战。第三，并购重组领域仍为内幕交易违法“重灾区”。实控人、董监高等“上市公司内部人”内幕交易多发，并购重组的标的公司、对手方高管涉案亦呈高发态势，内幕信息管控存在缺陷。窝案、串案增多，借用账户实施内幕交易现象较为普遍，避损型内幕交易时有发生。返回搜狐，查看更多责任编辑：
